Terms of Service

By creating an account or using the RunsForAll or BrainGainz mobile applications (each, an "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use either App. By creating an account, you confirm that you are 13 or older. If you are between 13 and 17 years old, you confirm that you have your parent or guardian's permission to use the App.

2. Your Account

  • You are responsible for maintaining the confidentiality of your account.

  • You must provide accurate information, including your name, date of birth or age, and (where applicable) email.

  • You may not create an account on behalf of someone else.

  • You may only have one account per App.

3. Acceptable Use

You agree not to:

  • Provide false information about yourself, your sport, or your age

  • Harass, threaten, or abuse other users or coaches

  • Post offensive, obscene, or discriminatory content

  • Use the App for any illegal activity

  • Impersonate another person

  • Attempt to reverse-engineer, hack, or disrupt the App or its servers

  • Scrape or collect other users' data without consent

  • Use the App if you are under 13 years of age

RunsForAll

  • Post false, misleading, or fraudulent run listings

BrainGainz

  • Share your coach access code with anyone not authorized by your coach or team

4. Your Content

You retain ownership of the content you create in the App — including run listings, profile information, ratings, journal entries, and wellness notes. By using the App, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and process that content to provide the App's features (e.g., displaying run listings to other users, or showing your training history back to you).

You are solely responsible for the content you post. We reserve the right to remove any content that violates these Terms or our community standards. We do not share BrainGainz journal entries or wellness notes with coaches or other users.

5. Content Reporting and Moderation

We provide tools for users to report offensive content and block other users. We review reports and take action — including removing content or suspending accounts — within a reasonable time. To report content or a user, use the report function within the App or contact us at support@onubogusports.com.

6. Subscriptions and Billing (BrainGainz)

Some features may require a paid subscription. Subscriptions are billed through the applicable app store (Apple App Store or Google Play) and are subject to that platform's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period through your app store account settings. Refunds are handled according to the policies of the applicable app store.

7. Account Deletion

You may delete your account at any time from Settings → Delete Account within the App. For security, this requires you to have signed in recently; if not, you will be asked to sign in again before deletion. Your account and all associated data — including profile information, run listings, training history, MPI scores, journal entries, and wellness check-ins — will be permanently removed within 30 days.

We may suspend or terminate your account if you violate these Terms.

8. Location Data (RunsForAll)

RunsForAll uses your location to show nearby pickup games. Location access is optional but required for full App functionality. See our Privacy Policy for details.

9. Disclaimers

RunsForAll facilitates connections between players for pickup sports games. We are not responsible for the conduct of any user at a game or event, the accuracy of run listings posted by users, or any injuries or incidents occurring at games found through the App. Participation in pickup sports carries inherent risk — you participate at your own risk.

BrainGainz is a sport performance training tool designed to help athletes build mental performance skills such as focus, reaction time, and decision-making. It is not a mental health service, medical device, or clinical/diagnostic tool, and is not a substitute for professional medical or psychological care. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services. Training results, MPI scores, and wellness check-ins are provided for informational and training purposes only.

10. Coaches and Teams (BrainGainz)

If you connect your account to a team using a coach access code, your coach will be able to view your aggregated training and performance data. You can disconnect from a team or delete your account at any time to end this access.

11. Limitation of Liability

To the fullest extent permitted by law, Onubogu Sports LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of either App.

12. Changes to These Terms

We may update these Terms at any time. Continued use of either App after changes constitutes acceptance of the updated Terms. We will notify users of material changes via the App or email where possible.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

14. App Store Terms

If you downloaded the App from the Apple App Store, you also agree to the following, which are between you and Onubogu Sports LLC, not Apple, and Apple has no responsibility for the App or its content:

  • This Agreement is concluded between you and Onubogu Sports LLC only, and not with Apple Inc. ("Apple"). Onubogu Sports LLC, not Apple, is solely responsible for the App and its content.

  • The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's App Store Terms of Service.

  • Apple has no obligation to furnish any maintenance or support services with respect to the App.

  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty will be Onubogu Sports LLC's sole responsibility.

  • Onubogu Sports LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

  • In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Onubogu Sports LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  • You must comply with any applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).

  • Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
